By booking a free demo session, enrolling a child, making any payment, or otherwise using our Services, you ("you," "Parent," or "Guardian") confirm that you are at least 18 years of age, that you are the parent or legal guardian of the child being enrolled ("Student"), and that you accept and agree to be bound by these Terms in full. If you do not agree, you must not use our Services.

These Terms constitute a legally binding agreement between you and Wys-Peer. Please read them carefully and retain a copy for your records.

03Eligibility and Account Registration

3.1 Who can register

Only a parent or legal guardian aged 18 years or older may create an account, enroll a Student, and accept these Terms. Wys-Peer does not permit children under 18 to enter into this agreement directly.

3.2 Accurate information

You agree to provide accurate, current, and complete information during registration and to update such information when it changes. Misrepresenting the age of the Student, providing false identity information, or using another person's payment method without authorization is grounds for immediate termination without refund.

3.3 Geographic scope

The Services are offered to families residing in the United States and Canada. We do not currently accept enrollments from other jurisdictions. By enrolling, you confirm that your primary residence is within the United States or Canada.

3.4 Account security

You are responsible for maintaining the confidentiality of any login credentials, calendar invites, or session links shared with you, and for all activity that occurs under your account.

04Description of Services

4.1 Tutoring format

Wys-Peer delivers live, online, small-group mathematics tutoring for Students from UKG through Grade 8. Each Batch comprises up to three (3) Students at a comparable level, instructed by a certified Wys-Peer teacher via Google Meet.

4.2 Session structure

Each Session is 60 minutes in duration and follows a structured format covering warm-up, new concept introduction, peer problem-solving, real-world application, and Q&A.

4.3 Curriculum

Our curriculum is aligned with United States Common Core State Standards and applicable Canadian provincial standards, supplemented by real-world application content developed by Wys-Peer. Curriculum content, sequencing, and pedagogical methods may be updated from time to time to improve learning outcomes; such updates do not constitute a material change to these Terms.

4.4 No guarantee of outcomes

While we are committed to delivering high-quality instruction, Wys-Peer makes no warranty, express or implied, regarding specific academic outcomes, grade improvements, examination scores, school placement, or admission to any institution. Learning outcomes depend on factors including Student engagement, attendance, and at-home reinforcement, which are outside our control.

05Demo Session, Enrollment, and Fees

5.1 Free demo session

Every Student is entitled to one (1) free 60-minute Demo Session before enrollment. The Demo is provided without charge and without any obligation to enroll. A written diagnostic summary is provided to the Parent within two (2) hours of session completion.

5.2 Enrollment fees

Enrollment is offered as a one-time payment (not a recurring subscription). Fees are tiered by Grade Band, reflecting the increasing curriculum depth and instructional rigor required at higher grades.

5.3 Payment method

All Fees are quoted in United States Dollars (USD) and payable in full at the time of enrollment exclusively through Razorpay International, our authorized payment processor. We do not currently accept payment through any other method, including direct bank transfer, cheque, wire transfer, or alternative payment platforms. Enrollment is confirmed only upon receipt of cleared payment from Razorpay.

5.4 Currency and taxes

Fees are quoted and charged in USD. Razorpay may apply currency conversion at prevailing rates for cardholders whose card is issued in a currency other than USD; such conversion is between you and your card issuer. Fees are inclusive of applicable processing charges but exclusive of any sales, value-added, goods and services tax, or similar taxes that may be levied by your jurisdiction. You are responsible for any such taxes.

5.5 No automatic renewal

Wys-Peer does not operate any subscription, auto-renewal, or recurring billing model. Upon completion of an enrolled Level, you are free (but not obligated) to enroll in the next Level via a separate one-time payment.

5.6 Grade Band assignment

The Grade Band applicable to your Student is determined by the Student's current grade at the time of enrollment, as confirmed during the Demo Session. If a Student is promoted to the next Grade Band during an active enrollment, the original Fee remains valid for the remainder of the enrolled Level; the new Grade Band pricing applies only to any subsequent enrollment.

06Refund Policy

6.1 No-questions-asked refund window

If you are not satisfied with the Services for any reason, you may request a full refund of the Fee paid, with no questions asked, at any time before the completion of the second (2nd) Session in the enrolled Level.

To exercise this right, you must email a refund request to billing@wyspeer.com from the email address on file before the start of the third (3rd) scheduled Session. Refunds will be processed within seven (7) business days through the original Razorpay payment channel to the original payment method. Receipt of refunded funds in your account may take an additional 3–10 business days depending on your card issuer.

6.2 No refund after Session 2

After completion of the second (2nd) Session in the enrolled Level, all Fees are non-refundable. This applies whether the Student stops attending voluntarily, fails to attend without notice, withdraws for personal reasons, or for any other reason whatsoever, except as required by applicable law.

6.3 Bundle and full-course refunds

For the Explorer + Achiever Bundle and the Full Mastery Course, the no-questions-asked refund window applies to the first two (2) Sessions of the entire bundle/course, not the first two Sessions of each Level. Once the third (3rd) Session begins, the entire Fee becomes non-refundable.

6.4 Refunds required by law

Nothing in this Section limits any non-waivable refund right you may have under applicable consumer protection law in your state, province, or country of residence. If a refund is mandated by such law, Wys-Peer will comply in accordance with that law, notwithstanding any other provision of these Terms.

6.5 No retention contact

When a refund is requested under Section 6.1, Wys-Peer will not call you, message you, or contact you for retention purposes. We will process the refund and confirm in writing. We would rather lose a customer than trap one.

6.6 Chargebacks

If you initiate a payment card chargeback or Razorpay dispute for any amount that is not refundable under Sections 6.1 or 6.4, you agree that Wys-Peer may contest the chargeback with full documentation of services rendered. Initiating a chargeback in bad faith may result in immediate suspension of Services and forfeiture of any remaining Sessions.

07Class Schedule

7.1 Scheduling

Sessions are scheduled twice (2x) per week at a fixed day and time agreed during the post-Demo onboarding call. Schedules are aligned to the Batch and cannot be changed unilaterally by an individual Parent.

7.2 Time zones

Sessions are operated across four time-zone windows: US Eastern evening, US Pacific evening, Saturday morning Eastern, and Saturday morning Pacific. You will select a window during onboarding.

7.3 Holidays

Wys-Peer observes a small number of fixed annual breaks (announced at the start of each calendar year). These breaks do not count against the 30-Session count for the enrolled Level. Sessions falling on US/Canadian federal holidays may be rescheduled at our discretion.

08Attendance and Makeup Classes

8.1 Attendance expectation

Consistent attendance is essential for learning outcomes. Parents are expected to ensure the Student is logged in, prepared, and on time for each scheduled Session.

8.2 Makeup class entitlement

Each 30-Session Level entitles the Student to a maximum of five (5) Makeup Classes. A Makeup Class is a replacement session scheduled in a different Batch (or a dedicated makeup slot, subject to availability) to cover a Session the Student could not attend.

8.3 How to request a makeup

To qualify for a Makeup Class, the Parent or the assigned teacher must request the makeup by writing to support@wyspeer.com or via the Wys-Peer WhatsApp channel at least twelve (12) hours before the scheduled Session, citing travel, illness, family commitments, or other reasonable cause. Late requests are honored at our sole discretion.

8.4 Beyond the 5-class limit

After the five (5) Makeup Classes for a given Level have been used, any subsequent missed Session — whether due to no-show, late cancellation, or any other reason — will be counted as a completed Session against the enrolled 30-Session count, and no refund or replacement will be due. We strongly encourage Parents to schedule travel and other commitments around the Session calendar wherever possible.

8.5 Makeup class scheduling

Makeup Classes are scheduled in a Batch at the same Level and Grade Band, subject to availability. We cannot guarantee a Makeup Class will be available on a specific date or with the Student's regular teacher. Makeup Classes must be used within thirty (30) days of the missed Session or by the end of the enrolled Level, whichever comes first.

8.6 Wys-Peer's cancellation of a session

If Wys-Peer cancels a scheduled Session for any reason (including teacher illness, technical failure, or operational issues), that Session does not count against the 30-Session entitlement or the 5-Makeup limit. A replacement Session will be scheduled at no additional cost and does not consume your Makeup entitlement.

09Technical Requirements

To attend Sessions, the Student must have access to:

  • A laptop or desktop computer (Sessions are not optimized for mobile phones or tablets; interactive features may not function on iOS devices).
  • Google Chrome or Microsoft Edge browser, updated to the latest version.
  • A stable broadband internet connection (minimum 5 Mbps recommended).
  • A working webcam and microphone.
  • A free Google account to join Google Meet sessions.
  • A quiet, well-lit space conducive to focused learning.

Wys-Peer is not responsible for missed or degraded Sessions caused by your equipment, internet connection, power outages, or other circumstances within your control.

10Code of Conduct

10.1 Student conduct

Students are expected to behave respectfully towards the teacher and peers, refrain from disruptive behavior, attend Sessions free from distractions, and engage in good faith with the learning material. We may, at our discretion and with prior notice to the Parent, remove a Student from a Batch if conduct repeatedly disrupts the learning of other Students.

10.2 Parent conduct

Parents are expected to communicate respectfully with Wys-Peer staff, teachers, and other parents. Abusive, threatening, or harassing communication — whether by email, phone, WhatsApp, or in any public forum — may result in suspension of Services without refund.

10.3 No recording without consent

Parents and Students may not record, screenshot, or redistribute any Session video, audio, or materials without prior written consent from Wys-Peer. Wys-Peer may record Sessions for quality and training purposes; recordings, if made, are governed by our Privacy Policy.

11Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Wys-Peer Content solely for the personal educational use of the enrolled Student during the term of enrollment. You may not copy, modify, distribute, sell, lease, sublicense, or commercially exploit any Wys-Peer Content. Use of Wys-Peer Content to train any artificial intelligence model is expressly prohibited.

"Wys-Peer," "Beyond Toppers," the puzzle-piece mark, and all related brand elements are trademarks of XIVB Education LLP. You may not use these marks without our prior written consent.

12Privacy and Children's Online Protection

Our collection, use, and protection of personal information — including the special protections that apply to children under the age of 13 under the United States Children's Online Privacy Protection Act (COPPA) and analogous protections under Canadian law and India's Digital Personal Data Protection Act 2023 — are described in our Privacy Policy. By accepting these Terms, you confirm that you have read and accepted the Privacy Policy.

As a Parent, you have specific rights with respect to your child's personal information, including the right to review, delete, and refuse further collection. See the Privacy Policy for details.

13Termination

13.1 Termination by you

You may stop using the Services at any time. Subject to Section 6, no refund is payable after the second (2nd) Session.

13.2 Termination by Wys-Peer

We may suspend or terminate your access to the Services, with or without notice, if you (a) materially breach these Terms; (b) initiate a bad-faith chargeback; (c) engage in conduct prohibited under Section 10; or (d) provide false information during registration. In cases of termination for breach, no refund will be due.

13.3 Effect of termination

Upon termination, your right to access the Services and Wys-Peer Content ceases immediately. Sections 6, 11, 14, 15, 16, and 18 survive termination.

14Disclaimer of Warranties

15Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

16Indemnification

You agree to indemnify, defend, and hold harmless XIVB Education LLP, its partners, employees, teachers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your breach of these Terms, (b) your violation of any applicable law, (c) your violation of any third-party right including any intellectual property or privacy right, or (d) any false information you provide to us.

17Governing Law and Dispute Resolution

17.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. Nothing in this Section limits any non-waivable consumer protection right you may have under the laws of your state, province, or country of residence (including, where applicable, the laws of the United States, individual US states, Canada, or Canadian provinces).

17.2 Informal resolution

Before initiating any formal dispute, you agree to first contact us in writing at legal@wyspeer.com and allow us thirty (30) days to attempt to resolve the matter informally.

17.3 Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties, or failing such agreement, in accordance with the Act. The seat and venue of arbitration shall be Bangalore, Karnataka, India. The language of arbitration shall be English. The arbitration award shall be final and binding on both parties.

17.4 Jurisdiction

Subject to Sections 17.1 and 17.3, the courts at Bangalore, Karnataka, India shall have exclusive jurisdiction to entertain and adjudicate any matter not subject to arbitration under these Terms. Nothing in this Section prevents you from bringing a claim before a court of competent jurisdiction in your state, province, or country of residence to enforce any non-waivable consumer protection right you may have under such law.

17.5 Class action waiver

18General Provisions

18.1 Entire agreement

These Terms, together with our Privacy Policy and any enrollment-specific terms presented at checkout, constitute the entire agreement between you and Wys-Peer concerning the Services.

18.2 Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you by email at least thirty (30) days before they take effect. Continued use of the Services after the effective date of a change constitutes acceptance of the updated Terms.

18.3 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

18.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or restructuring of XIVB Education LLP, with notice to you.

18.5 No waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

18.7 Force majeure

Neither party shall be liable for any failure or delay in performance under these Terms due to any cause beyond its reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, government action, internet or telecommunications failures, or labor disputes.
